Terms of Use

These Terms of Use supplement the Terms and Conditions; in case of any discrepancy, the Terms and Conditions prevail, and the Polish version of this document prevails over this translation.

1. Acceptance and age

By using the “Tropiciel Wrażeń” App you confirm that you are at least 18 years old and that you accept these Terms of Use, the Terms and Conditions and the Privacy Policy. If you do not agree with them, do not use the App.

2. Nature of the content

The App is entertainment and contains adult content and an alcohol-drinking theme.
Tasks are suggestions for play — carrying them out is voluntary. You can always decline (pass), and declining is a built-in part of the game.
The content is fictional and for entertainment; it is not medical, psychological or legal advice.
The content catalogue changes — tasks may be added, modified and removed remotely.

3. Responsible use

Drink responsibly and lawfully. Do not pressure anyone into drinking or into acting against their will.
Do not use the App while driving, operating machinery, or in any other situation where it could endanger safety.
Respect the boundaries and consent of every participant. Tasks involving more than one person require the agreement of each of them.
Do not use the App if it is inadvisable for health reasons, and do not serve alcohol to minors or to anyone who must not consume it.
The game does not require drinking alcohol — “sips” can be replaced with any non-alcoholic drink.

4. Licence and ownership

You receive a personal, non-exclusive, non-transferable and revocable licence to use the App for private, non-commercial purposes. All rights to the App, its content, graphics, trade marks and code belong to the Operator or its licensors.

5. Prohibited conduct

Copying, distributing, selling or publicly sharing the App’s content beyond its normal use, including publishing collections of tasks.
Decompiling, reverse engineering, and circumventing security measures, payment mechanisms or access controls for paid content.
Disrupting the App or its servers, unauthorised access to other users’ accounts, automated scraping of content.
Using the App in commercial activity (for example, running paid game events) without the Operator’s consent.
Any use that is unlawful or infringes third-party rights.

6. Content you enter

When entering data — in particular players’ names — you warrant that it is neither unlawful nor offensive and that you are entitled to provide it. Note that names are saved together with the room and, when you are signed in, are also sent to our server; see the Privacy Policy for details. Use first names or nicknames rather than data that identifies someone more broadly.

7. Account and access to paid content

Access to paid content is tied to your account and is personal — do not share your credentials with others.
Starting a game may involve the automatic creation of an anonymous guest account; you can later link it to a permanent account, keeping your progress.
Rules on purchasing, renewal and cancellation are set out in §7 of the Terms and Conditions.

8. Disclaimer of warranties and liability

The App is provided “as is”. To the extent permitted by law, the Operator does not warrant uninterrupted and error-free operation and is not liable for how users carry out tasks, nor for the consequences of consuming alcohol. The foregoing does not exclude or limit consumer rights arising from mandatory provisions of law, including liability for the conformity of digital content with the contract.

9. Reporting infringements

If you believe that content in the App breaches the law or your rights, write to shop@eye4fun.pl describing what the report concerns. We review such reports without undue delay and inform you of the outcome.

10. Changes

The Operator may update these Terms of Use. We announce changes in the App; continued use after they take effect requires acceptance of the new version.
