Terms and Conditions — “Tropiciel Wrażeń”

Version 1.0 · Effective from: 1 September 2026

This is a translation for convenience. In case of any discrepancy, the Polish version prevails.

§1. General provisions and definitions

  1. These Terms govern the use of the web and mobile application “Tropiciel Wrażeń” (the “App”), available at game.eye4fun.pl.
  2. Operator (service provider): Oskar Bujak and Alicja Bartkowska, acting jointly under the eye4fun brand, service address: ul. Aluzyjna 33, 03‑149 Warsaw, Poland, e‑mail: shop@eye4fun.pl. The service providers are jointly and severally liable towards the User.
  3. User — a natural person aged 18 or over who uses the App.
  4. Account — the User’s data and permissions in the App. This includes a guest account (anonymous), created automatically — see §5(2).
  5. Subscription — paid, time-limited access to content and features, renewing automatically until cancelled.
  6. One-off purchase — paid, permanent unlocking of a given content pack.
  7. Payment provider — Stripe Payments Europe, Ltd., which handles payments in the App.

§2. Nature and scope of the service

  1. The App is a party card game intended exclusively for adults (18+). It contains adult content and an alcohol-drinking theme.
  2. The App supports local play (on a single device passed between players). Online play and further account features are in preparation and will be released gradually.
  3. Content (tasks, cards, levels) is delivered and updated remotely — it may change, be added to and be removed without an App update.
  4. Some content is free. Access to the remaining packs requires a Subscription or a One-off purchase.
  5. Local play also works without an internet connection, using content previously stored on the device.

§3. Technical requirements

  1. You need an up-to-date web browser or an Android device, and — for the account, payments and content downloads — an internet connection.
  2. The App stores data in local browser or device storage (including localStorage and IndexedDB). Clearing it removes saved rooms, game progress and your acceptance of these Terms.
  3. The Operator is not responsible for disruptions caused by factors beyond its control (network, hardware, third-party software, browser settings blocking local storage).

§4. Age and access

  1. Only persons who are at least 18 years old may use the App.
  2. By starting to use the App, the User declares that they are of age and accepts these Terms, the Terms of Use and the Privacy Policy. The declaration is made by choosing any entry option on the start screen.
  3. The App is not directed at minors and does not serve to promote alcohol consumption.

§5. Account

  1. Local play does not require a permanent account. An account is required to purchase a Subscription or a pack, to download content from the server and — in the future — for online play.
  2. Guest account. When you start a game, the App may automatically create an anonymous technical account in order to download content and synchronise saved rooms. A guest account holds no e‑mail address or surname; it can be linked to a permanent account at any time, preserving your progress.
  3. Sign-in to a permanent account is available via Google or via e‑mail and password. Sign-in with Apple may be added in the future.
  4. The User is responsible for keeping their credentials confidential and for actions taken from their Account.
  5. Account deletion. The User may delete their Account and associated data themselves in the App (Account screen → “Delete account”) or by writing to shop@eye4fun.pl from the address linked to the Account. Instructions and the scope of deleted data: account deletion. We action such requests without undue delay and no later than within 30 days. Deleting the Account does not erase data stored locally on your device — remove that by clearing the app or browser data.

§6. Rules of use

  1. Detailed rules on permitted use and conduct are set out in the Terms of Use.
  2. Supplying unlawful content and using the App in a way that breaches the law or third-party rights is prohibited.
  3. When entering the names of other participants, the User undertakes not to enter data they have no right to process, nor offensive content.

§7. Payments, Subscriptions and purchases

  1. Prices are shown in the App before purchase, in Polish zloty (PLN), and include VAT where applicable.
  2. Payments are handled by Stripe. The purchase takes place on Stripe Checkout; the Operator does not process or store payment card numbers.
  3. Two payment models are available:
    • Subscription — in time-based variants (including 3 days, a week, a month, a year), renewing automatically;
    • One-off purchase — permanent access to a given content pack.
  4. A Subscription renews automatically for a further period unless cancelled before the end of the current billing period. Cancellation is done in the App, on the Account screen. Cancellation takes effect at the end of the paid period — access continues until then and is not refunded pro rata.
  5. The Operator may change prices and the scope of plans. Changes do not affect periods already paid for; the User will be informed of a price change to a renewing Subscription before it applies.
  6. If the App is in future made available on Google Play or the App Store, purchases made through those channels will additionally be subject to the terms and settlement procedures of the relevant store.

§8. Digital content and licence

  1. The Operator grants the User a non-exclusive, non-transferable licence to use the App and the content made available, solely for personal, non-commercial use.
  2. All rights to the App, its content, graphics, marks and code belong to the Operator or its licensors.
  3. The content catalogue changes over time. The Operator takes care that a pack matches its description at the time of purchase and does not remove content from a paid pack in a way that materially reduces its value.

§9. Right of withdrawal

  1. A consumer has the right to withdraw from the contract within 14 days of its conclusion, without giving a reason. A statement sent to shop@eye4fun.pl is sufficient.
  2. The right of withdrawal does not apply to digital content not supplied on a tangible medium if performance has begun with the User’s express and prior consent, after the User acknowledged the loss of the right of withdrawal and the Operator confirmed this.
  3. If such consent was not obtained before performance began, the right of withdrawal applies on general terms and the amount paid is refundable.

§10. Complaints

  1. Complaints may be submitted to shop@eye4fun.pl, describing the problem and providing contact details. A reporting form is also available in the App, on the Account screen.
  2. Complaints are handled within 14 days of receipt.
  3. The Operator is liable to consumers for the conformity of digital content with the contract under the Polish Consumer Rights Act.

§11. Liability

  1. The App is for entertainment. Users use it and perform tasks voluntarily and at their own risk. The Operator is not liable for how Users carry out tasks, nor for the consequences of consuming alcohol.
  2. To the extent permitted by law, the Operator is not liable for indirect damage; these limitations do not exclude or limit consumer rights arising from mandatory provisions of law.
  3. Drink responsibly. Do not use the App in situations where doing so may endanger health or safety.

§12. Suspension and termination

  1. The Operator may suspend or block access in the event of a material breach of these Terms or of the law, stating the reason.
  2. The User may stop using the App and delete it and their Account at any time (§5(5)).

§13. Changes to these Terms

The Operator may amend these Terms for important reasons (including changes in law, service scope, technology or the payment model). The User will be informed in the App, and continued use after the changes take effect requires renewed acceptance. Changes do not worsen the conditions of periods already paid for.

§14. Governing law and disputes

  1. Polish law applies; this does not deprive a consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
  2. A consumer may use out-of-court complaint and redress procedures, in particular the assistance of a district (municipal) consumer ombudsman, the provincial inspector of the Trade Inspection, and permanent consumer arbitration courts. Information about these routes is provided by the Polish Office of Competition and Consumer Protection (uokik.gov.pl).

§15. Final provisions

Matters not covered here are governed by Polish law, including the Civil Code, the Act on Providing Services by Electronic Means and the Consumer Rights Act.
